1. Acceptance of Terms

By accessing or using the Cigar Academy Members Club website, platform, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Services.

These Terms constitute a legally binding agreement between you and the Cigar Academy Members Club, operated in Switzerland. By using the Services, you represent that you are at least 21 years of age.

2. About the Club

The Cigar Academy Members Club is a private, premium cigar lounge and members community operated in Switzerland. The Club is not a public body, charity, or non-profit organization. All decisions regarding operations, membership, and direction are made at the sole discretion of the Club management.

3. Membership

Membership in the Cigar Academy Members Club is granted entirely at the discretion of the Club. The Club reserves the right to accept, decline, suspend, or revoke membership at any time, for any reason consistent with its values and mission.

Membership does not create any employment, partnership, joint venture, or agency relationship.

Members must comply with the Code of Conduct, these Terms, and any additional guidelines published by the Club.

4. User Accounts

To access certain features of the Services, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Content Ownership

You retain ownership of any content you submit, post, or display through the Services ("User Content"). By posting User Content, you grant the Club a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your User Content solely in connection with operating and promoting the Services.

6. Acceptable Use Policy

You agree not to use the Services to:

  • Violate any applicable law, regulation, or third-party rights
  • Post content that is defamatory, obscene, threatening, or hateful
  • Harass, bully, intimidate, or discriminate against any person
  • Impersonate any person or entity
  • Distribute spam, malware, or engage in phishing
  • Attempt to gain unauthorized access to the Services
  • Engage in any conduct that brings disrepute to the Club or its members

7. Limitation of Liability

To the fullest extent permitted by law, the Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. The Club shall not be liable for any indirect, incidental, special, or consequential damages.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Switzerland. Any disputes shall be subject to the exclusive jurisdiction of the courts in Switzerland.

9. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to members via the platform or email with at least fourteen (14) days' notice.
